Thank you for being a fan of Adventure Academy™! Age of Learning, Inc. (“we”, “our”, “us”, or the “Company”), the owners and operators of Adventure AcademyTM, are thrilled by the fan community’s enthusiasm, creativity and passion for our game, characters, assets, artwork, animation, logos, trademarks, and intellectual property (collectively, “IP”). We love that our users, whether parents or legal guardians and their child or children (collectively, “you” or “fans”), enjoy creating and sharing your unique creations based upon our IP, such as gameplay tutorials and fan sites (“Fan Content”). However, we put a lot of time, thought, effort and money into our IP and need to protect it. We also need to protect our users, fans, and the general public in determining when content is officially produced by us in order to avoid confusion or even fraud.
Using our IP without our permission is generally a violation of our rights and against the law. However, in order to support the fan community, we put together this policy so that you understand what you can and cannot do with our IP when creating and sharing your Fan Content. PLEASE READ THIS POLICY CAREFULLY BEFORE CREATING OR SHARING ANY FAN CONTENT. WE RESERVE THE RIGHT TO CHANGE OR REVOKE THIS POLICY AT ANY TIME. In addition, this policy and your use of our IP in your Fan Content, is subject to and must abide by our Terms & Conditions, Privacy Policy and Community Guidelines. In the event of a conflict between this policy and the aforementioned policies, the aforementioned policies shall govern. Check out our FAQs to better understand this policy.
By creating Fan Content, you understand and agree that others and the Company may use, promote or share your Fan Content for any purpose.
If we determine that your Fan Content violates any of the rules in this policy, we may ask you to take down your Fan Content, and you agree that you will do so promptly. We reserve the right to contact the platform hosting your Fan Content to request its removal, and nothing in this policy waives our rights to remove Fan Content.
Your Fan Content must abide by the following rules:
- Fan Content Must Be Free
You may only share Fan Content if it is offered for free. Free means you cannot:
- require payments, subscriptions, email registrations, or downloads to access your Fan Content;
- sell or license your Fan Content;
- restrict your Fan Content from being viewed or shared.
You can, however, display your Fan Content on social media channels and collect advertising revenue or donations via such social media platform’s tools, such as YouTube or Twitch. You may not, however, accept paid sponsorships of your Fan Content.
- Fan Content Must Clearly Be Labeled “Unofficial”
You must make it clear that your Fan Content is not endorsed or sponsored by the Company, or give the impression that it is officially created or published by us. You may not use our logo in the title, headings, footings, or framing of your Fan Content. You may not use the Adventure AcademyTM name as the first phrase in the title of your Fan Content, but you may use it as a second phrase in order to describe your Fan Content. Also, you must include the following disclaimer in connection with your Fan Content:
- “[Title of your Fan Content] is unofficial, and is not approved or endorsed by Adventure AcademyTM or Age of Learning, Inc. Portions of the materials used are the copyrights and/or trademarks of Age of Learning, Inc.”
Additionally, you will not register or use any domain names or social handles that are confusingly similar to our domain names and social handles.
- Fan Content Must Be For Fan Enjoyment Purposes Only
Your Fan Content must be solely used and shared for the purposes of the enjoyment by the fan community. This means you will not create or use Fan Content to promote yourself or any products, services, businesses, brands or advertisers, and that your primary purpose will not be to monetize or commercialize your Fan Content. Additionally, you may not create new products or services based on our IP, such as t-shirts. You may not create a new game based on our IP, even if the game is free.
- Fan Content Must Respect Third Party IP
Your Fan Content must not contain the intellectual property of others, such as art, images, songs, characters, videos, or similar items, unless you have the rights, licenses and/or permissions to do so.
- Fan Content Must Respect Privacy
Your Fan Content must not disclose the personal information of others. Therefore, you should not include any Private Chats or Club Chats from your gameplay within any Fan Content. You may post General Chats from your gameplay within your Fan Content, except if the General Chat discloses any personal information from or about any players, such as a player’s name, profile information, address, birthdate, contact information, school, social media handles, or similar identifying or sensitive information.
- Fan Content Must Respect Others
Your Fan Content must not hurt others. This means, your Fan Content must not be inappropriate, offensive, damaging, or disparaging of others, including players in the game, people you know, people you do not know like celebrities, or the Company. You may not create Fan Content that embarrasses, harasses, bullies, or abuses others, or that is considered “revenge” content. If your Fan Content is going to include others, whether other players in the game or those not in the game, you must get their permission beforehand.
- Fan Content Must Be Respectful & Appropriate
Your Fan Content must not contain violence, obscenity, spam, deception, or vulgar, derogatory or discriminatory language. Fan Content must be appropriate for the audience of our IP, which is generally kids ages 2-12, and consistent with the spirit and tone of our IP.
- Fan Content Must Not Modify Our IP
Your Fan Content must not modify any of our IP. Do not modify our trademarks or logos, including changing any of the colors or fonts. Do not remove any copyright/trademark notices or legal disclaimers from our IP that you are incorporating into your Fan Content. Mods to gameplay are not allowed.
- Fan Content Must Abide By Laws and Platform Terms
Your Fan Content must abide by all applicable laws of where your Fan Content is created and shared, and all terms, policies, and guidelines of any platform that you utilize to create or share your Fan Content, such as YouTube’s or Instagram’s terms of service, privacy policy, and community guidelines.
- Fan Content Must Not Include Sweepstakes Or Contests
Your Fan Content cannot contain, be part of, or connected to, any sweepstakes, contest or giveaways, whether run by you or by others.
FREQUENTLY ASKED QUESTIONS
Q: What is typically considered Fan Content?
A: Free fan pages, blogs, gameplay or tutorial videos. Remember, Fan Content is something you create based on your imagination and creativity that is sparked by our IP, but it should never be just a straight copy of our IP with nothing more. For example, a gameplay video alone is a straight copy and is not allowed by us because that is not fair to those who have paid to access the game. However, a gameplay video with your audio commentary about your unique thoughts related to gameplay is allowed.
Q: Does Fan Content include live streams?
A: Yes. Just follow the rules in this policy while livestreaming.
Q: Are comments on a YouTube video or Instagram post considered Fan Content?
A: No. If you see user comments that are offensive or inappropriate, please report them to YouTube or Instagram or the relevant hosting platform.
Q: What type of products are not allowed?
A: Merchandise of any kind, like t-shirts, hats, mugs, dolls, figures, coloring books, sticker books, and similar products, that use our IP. Games that use our IP are also not allowed, even if they are free.
Q: Can I ask someone to pay me money to get my Fan Content?
A: No, your Fan Content must be free.
Q: Can I ask someone to give me their email address before showing them my Fan Content?
A: No, your Fan Content must be free. If they like your Fan Content and ask you to send them more via email, then that is ok.
Q: Can I use the Adventure AcademyTM name or logo in the title of my Fan Content?
A: You may not use the logo in the title. You may use the Adventure AcademyTM name only for description purposes. You may not use the Adventure AcademyTM name as the first phrase of your title. For example, you may title a gameplay video: “[Your Name]’s Tutorial for Adventure AcademyTM,” but you cannot title it “Adventure AcademyTM Tutorial by [Your Name]”.
Q: My YouTube Channel where I show my gameplay of Adventure AcademyTM is popular and a juice brand wants to pay me to create a gameplay video featuring their product and brand. Is this allowed?
A: No, we do not want third party products or brands being advertised against our IP in your Fan Content. However, you may run standard YouTube ads against your gameplay content (i.e., a variety of advertisements that are usually pre-roll video ads) and collect any ad revenue generated through your YouTube channel.
Q: Can I use Adventure AcademyTM characters, like any of the Professors, on my fan page?
A: Yes, so long as you follow the rules in this policy.
Q: If I’m doing a gameplay video, do I need to remove your trademarks or logos that appear in the gameplay?
A: No, so long as you do not change the trademarks or logos in any way.
Q: Can the Company or others use and display my Fan Content?
A: Yes. This policy is dedicated to removing barriers to sharing. By making Fan Content, you agree to let others, including the Company, share and use your Fan Content without asking your permission and without providing you with any compensation.
Q: I created a cool video that contains my game Avatar and those of my friends. Can I post the video to my YouTube Channel and Instagram stories?
A: Yes, so long as you received permission from each of your friends that are in the video to do so.
Q: Can I post a Fan Content video that includes music?
A: No, not unless you obtained permission from the owner of the music. You are responsible for obtaining any necessary permissions to use music associated with your Fan Content. If you wrote the music by yourself so it is original, then it is ok.
Q: Can my gameplay video include the Private Chat or Club Chat I had with my two friends?
A: No, these chats are meant to be private between you and your friends. However, you can include your General Chat if you get your friends’ permission and the General Chat doesn’t include any personal information about any of you, such as the name of your school or your names on any social media platforms.
Q: Can I make fun of the way someone’s Avatar looks in a social media post?
A: No, your Fan Content must respect other players and making fun of someone’s Avatar is mean and against the rules.
